The Sedition and Treason Act applies to Trump

Former Senator and President of The New School Bob Kerrey says there is no ambiguity in the matter of Trump's incitement of insurrection.  Trump broke the law:

         §2383. Rebellion or insurrection

Whoever incites, sets on foot, assists, or engages in any rebellion or insurrection against the authority of the United States or the laws thereof, or gives aid or comfort thereto, shall be fined under this title or imprisoned not more than ten years, or both; and shall be incapable of holding any office under the United States.

 To be impeached, a president does not have to violate a law, but in this case Trump did.  His efforts to overturn a legitimate, free election were extensive.  More than 60 court cases were dismissed for lack of evidence of any voter fraud.  His attempts to get Georgia officials to change the state's vote tally were committed before the public.  His lies about the election constant and disproven.  His incitement speech to those who took over the Capitol was recorded and played over television.

The question is not whether Trump should be convicted, but whether the GOP senators are honest enough to do it. Trump's presidency has cast doubt about whether the United States can function as a democratic republic.  The Senate will make that determination.
